There are obvious difficulties in ensuring that homeworkers are paid not less than the national minimum wage. The National Minimum Wage Regulations have attempted to deal with the problem by providing for the possibility of entering into a written "Fair estimate agreement".This must set out a fair estimate (subject to the notorious "four fifths rule") of the hours needed to complete the work in question and the national minimum wage (at least) must be paid for hours worked up to that estimate. This system is obviously open to abuse and in February 2004 the government announced that a new system would come into effect from October 2004
